We represent groups of employees (in the restaurant, hospitality, call center, and other industries) in collecting compensation owed to them by employers who have violated federal and state employment law. These violations commonly include wage and hour violations, like “time-shaving”, unpaid overtime, illegal tip pooling or withholding of tips, illegal deductions for food or uniforms, deductions for credit card fees, unpaid time at the beginning or end of shifts, and other violations of law and regulations. We also represent consumers with claims involving fraud, unlawful credit card charges, telephone bill issues and overcharges, computer fraud, and other consumer-oriented claims.
We have negotiated, litigated and tried commercial disputes, supply and service contract disputes and other general business and commercial law claims, including claims involving restrictive covenants, and covenants not to compete, and can lend a special perspective to understanding your opponent’s thinking as a result.
Our practice also engages extensively in class action and collective action litigation on behalf of employees, consumers and other individuals to collect salary, commissions, wages, benefits and other pay and compensation wrongfully taken or not paid by their employers and other companies. We are currently involved in many such actions, primarily against employers who operate restaurants, retail stores, call centers or sales operations. Current or former employees, including restaurant servers, sales people, managers, executives, and others who believe that they have been unpaid or under paid, or treated wrongfully, can contact our firm to discuss their situation without charge.
We represent clients in claims related to privacy, including trade secrets, computer fraud, slander, libel, defamation, public disclosure of private facts, publicity rights, and privacy rights, which are increasingly important as information becomes more easily obtained and more valuable.
Our attorneys have successfully prosecuted fraud claims pursuant to the Illinois Consumer Fraud Act in state and federal court, on an individual basis and on a class action basis. We have been involved in litigating class action cases in the Circuit Court of Cook County, Illinois against a seller of home warranties; against Illinois utilities for overcharges; and against lenders for transaction overcharges. The firm represents policy holders of disability insurance in claims against their insurance companies, when an insurance company refuses to pay on legitimate claims of disability, life insurance, and other insurance policies and claims. We are familiar with the legal and factual arguments posed by insurance companies and their lawyers, when they deny legitimate claims. We have successfully collected millions of dollars for our clients from the litigation of these claims, in spite of those arguments.
